IMDH respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement that are reported to our designated agent.

1 Overview

The DMCA provides a process for copyright owners to notify online service providers about infringing content. If we receive a valid DMCA takedown notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the content about the removal
  • Provide information about the counter-notification process
  • Take action against repeat infringers
Before Filing a Notice

Consider whether fair use, fair dealing, or a similar exception might apply. Not all uses of copyrighted material constitute infringement. If you're unsure, we recommend consulting with an attorney.

2 Filing a DMCA Takedown Notice

If you believe that content on IMDH infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must be in writing and include the information specified below.

3 Required Information

To be effective, your DMCA takedown notice must include:

Signature

A physical or electronic signature of the copyright owner or authorized representative.

Identification of Work

Identification of the copyrighted work(s) claimed to have been infringed.

Location of Material

The URL(s) or specific location of the allegedly infringing material on IMDH.

Contact Information

Your name, address, telephone number, and email address.

Good Faith Statement

A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.

Accuracy Statement

A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Important

Incomplete notices may not be processed. Please ensure all required information is included in your submission.

4 Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification. To be effective, your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that was removed and its previous location
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  • Your name, address, and telephone number
  • A statement consenting to jurisdiction of the federal court in your district and that you will accept service of process from the person who filed the original notice

What Happens Next

Upon receiving a valid counter-notification, we will:

  • Forward a copy to the original complainant
  • Inform them that the removed content may be restored in 10-14 business days
  • Restore the content unless the complainant notifies us of legal action

5 Repeat Infringer Policy

IMDH maintains a policy for terminating accounts of users who are repeat infringers of intellectual property rights. Users who receive multiple valid DMCA notices may have their accounts suspended or terminated.

Our repeat infringer policy includes:

  • First Notice: Warning and content removal
  • Second Notice: Temporary suspension and content removal
  • Third Notice: Permanent account termination

We reserve the right to terminate any account at any time for egregious violations.

6 False Claims & Misrepresentation

Legal Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner, or the service provider.

Please be aware that filing false DMCA notices or counter-notifications is a serious matter. We recommend consulting with a legal professional before submitting any notice.
